1. Who is responsible for your data?

2. What personal data do we process?

Depending on how you interact with SQAIR, we may process:

• contact details and correspondence you provide when making an enquiry;
• business and project information needed to assess, quote, contract or deliver a service;
• billing, contractual and transaction records where we work together;
• for SQAIR Talent, CVs, employment history, qualifications, professional credentials, references and other information relevant to a search or placement;
• technical information generated when the website is requested, such as IP address, request time, browser/user-agent information and server/security logs handled by our hosting infrastructure.

Please do not send special-category personal data unless it is genuinely necessary for the matter at hand.

3. Why do we use personal data?

We use personal data to respond to enquiries, assess and deliver projects, manage client and supplier relationships, provide recruitment and specialist-search services, keep appropriate business records, protect the security of our systems and meet legal or regulatory obligations.

4. Legal bases

Depending on the processing, we rely on one or more of the following legal bases under the GDPR:

• steps before entering into a contract and performance of a contract, for enquiries, proposals and service delivery;
• legitimate interests, for ordinary business administration, relationship management, recruitment/search activity, service improvement and security, where those interests are not overridden by your rights;
• legal obligations, where records or disclosures are required by applicable law;
• consent, where the law specifically requires it. Where processing is based on consent, you may withdraw it at any time.

5. SQAIR Talent

When SQAIR Talent handles candidate information, we use it to assess suitability for a specific role, communicate about the search and, where relevant, present suitable candidates to the client organisation. We do not treat a CV as permission to circulate it without a recruitment purpose.

If we want to keep candidate information for unrelated future opportunities beyond what is reasonably connected to the original search, we will use an appropriate legal basis and, where required, ask for consent.

6. Who may receive personal data?

We may share data only where needed with clients involved in a relevant SQAIR Talent search, professional advisers, authorities where legally required, and service providers that support our business and technology.

Our website is hosted on Netlify. We also use Google Workspace for business communications and Google Calendar for optional call booking. If you choose an external service linked from this website, that provider may process information under its own privacy terms.

7. International transfers

Some technology providers may process data outside Malta or the European Economic Area. Where GDPR rules on international transfers apply, we use providers and transfer mechanisms intended to provide an appropriate level of protection, such as an adequacy decision or approved contractual safeguards.

8. How long do we keep data?

We keep personal data only for as long as reasonably needed for the purpose for which it was collected, to manage ongoing or potential business relationships, resolve issues, and meet applicable legal, accounting or regulatory requirements. Recruitment data is reviewed in light of the relevant search and any justified future-retention purpose.

9. Your rights

Subject to the GDPR and any applicable exceptions, you may have the right to request access to your personal data, correction, deletion, restriction, portability, or to object to certain processing. Where processing is based on consent, you may withdraw that consent.

You also have the right to lodge a complaint with Malta’s Information and Data Protection Commissioner (IDPC).
